Cortland County man accused of raping 13-year-old arraigned, out on pretrial release

A man accused of raping a 13-year-old was released at his arraignment Thursday in Cortland County. 

Authorities with the Cortland County Sheriff’s Office went to a residence on Cold Brook Road in the Town of Scott on Feb. 20 to investigate a sex abuse allegation. 

Police said the investigation revealed that 29-year-old Lee Wagner had inappropriate contact with a 13-year-old who was known to Wagner. The alleged contact took place “outside of a residence in the town of Scott,” according to police. 

Wagner turned himself in to the Cortland County Sheriff’s Office voluntarily on Wednesday. 

He faces the following charges:

  • Second-degree rape, a felony.
  • Second-degree criminal sex act, a felony. 
  • Second-degree criminal sale of marijuana, a felony. 
  • Endangering the welfare of a child, a misdemeanor.

Wagner was held pending arraignment Thursday. 

On Friday, a member of the Cortland County Sheriff’s Office said Wagner was “released at court” when he was arraigned. 

Police said Wagner was granted pretrial release as part of the alternative to incarceration program.

Wagner is to appear in the Town of Scott Court on March 3.
